European Directive 2013/11 and rule 524/2013 regulate the resolution of disputes among consumers and companies without a trial, with reference to the e-commerce. For this reason, a European platform called Online Dispute Resolution (ODR) (https://ec.europa.eu/consumers/odr/) has been created in order to allow any consumer claiming in case of purchase problem on maesmartgarden.com. The procedure starts with a notification to the seller from the ODR platform. Seller and consumer have to agree about a resolution body listed on ODR platform and share details in the draft complaint. The procedure ends as the third body proposes a resolution, that the consumer and seller can or not accept.
Please remember that this alternative disputes resolution is optional and voluntary and it doesn’t replace the legal one.
